1. Can you provide strategies to go around a Patent so my product doesn’t infringe?  I have done this multiple times and can do it again: however, each situation is different, so it would require an evaluation.


2. Can you invalidate a competitor’s patent or trademark?  I have done it before and can do it again; however, each situation is different, so it would require an evaluation.


3. Can you offer ideas for Patents?  Yes, I have experience being awarded 3 Patents by the USPTO.  Providing advice might just save you millions of dollars, whether it is to move forward or cancel your invention, modify your invention, or provide a innovative invention.


4. Can you offer ideas for Trademarks?  Yes, I have been awarded Trademarks by the USPTO and can do it again; however, each situation if different, so it would require an evaluation.  Providing advice might just save you lots of time and money.  Also, for many reasons, I don’t suggest Trademarks for all products or companies   


5. Do you offer brand product selection?  Yes, I can suggest products, dosage forms, delivery systems, and other creative solutions to offer new growth, market share, and profits to your company.


6. Do you offer generic product selection? Yes, I can suggest niche or large volume generics for your portfolio.  Even in crowded market places, I can offer ways to gain business.


7. Can you look over new or existing contracts?  Yes, whether it is, but not limited to, purchasing, selling, divesting, licensing, legal engagement, or supply agreements.

 

8. Can you help source items?  Yes, sourcing what you need with quality suppliers at competitive prices and mutually beneficial contracts will be determined with a plan of action.  This includes, but is not limited to, items that you want to purchase, items for divestment, or items you want to license.


9. How can you help us save money?  Analyzing contracts, suppliers, and new & existing opportunities, along with an internal audit of your company.  Canceling products when the market opportunity doesn’t exist as you may think.  Data & research proves to be extremely important, and sometimes, they are not as they seem.


10.   Is the US FDA always right?  No, although the US FDA can be right, there are times they are not.  I successfully achieved exclusivity status among finished dose pharmaceutical companies in the US for Methscopolamine Nitrate API when the US FDA said it was not allowed to be shipped into the US.  After numerous phone conversations and several emails, I provided enough evidence for them to agree.  In this situation, it is important to explain & educate in a friendly manner, not try to prove a point aggressively while being hostile.


11.   Are State Boards of Pharmacy or State Agencies that regulate pharmaceuticals always right?  No, although State Boards of Pharmacy or State Agencies can be right, there are times they are not.  I was told during an inspection that I was not allowed to market Diphenhydramine without an approval by an Inspector during an audit.  In a polite and humble manner, I explained it was allowed without an approval utilizing the OTC Monograph.  Although the agent was shocked and frustrated by my knowledge, the agent conceded.  In this situation, it is important to explain & educate in a friendly manner, not try to prove a point aggressively while being hostile.

 

12.   Are you available to assist in trade shows?  Yes, I am not only available for trade shows, I can provide guidance which trade shows are valuable to attend and which trade shows you should exhibit and which ones you should be a visitor.  I also have powerful strategies to attract people to your booth and also, have many of them re-visit during the same show multiple times.


13.   Can you provide legal support?  Yes, I can provide legal support; however, I am not an attorney, so I can’t provide legal advice.  Solutions/strategies that are, but not limited to, avoiding lawsuits, claims for lawsuits, Patents & Trademarks (Non-Infringing & Innovator Inventions), contracts, and so much more!

 

14.   What about Divestments & Licensing?  Whether you are offering a divestment or a license or you are searching for a divestment or license, I can assist.  Locating valuable deals within a targeted time frame achieving results that surpass your expectations motivates me.


15.   Do I have to be exclusive with S BUSMAN PHARMA CONSULTING? No, we can work out an arrangement that works best for both companies.  I don’t want you saying, “I am glad we are working together”, I want you saying, “I really wish I worked with you much sooner”!
